Company Policy
We want every project to begin with clear expectations and good communication. The following policies outline our general approach to design, plant sourcing, installation, scheduling, payment, and the care of living plant material.
General Disclaimer
Our designs and recommendations are based on professional judgment and the conditions reasonably observable or disclosed at the time services are provided. Landscapes and orchards are affected by natural and environmental conditions that cannot be completely predicted or controlled.
Nothing in these general policies replaces the terms of a project-specific proposal, contract, or service agreement. If a project agreement contains terms that differ from these general policies, the project agreement will control.
Design & Estimates
Consultations & Design Services
Every property is different. Recommendations are based on the conditions we can evaluate during the design process, including microclimate, sun exposure, and the client's goals. Design fees cover services described in your proposal. Work beyond the agreed scope may require additional fees.
Pricing & Estimates
Proposals are based on anticipated scope and current costs. Estimates are valid for the period stated. Pricing may adjust if projects are delayed or scope changes. We communicate changes before additional costs are incurred.
Changes & Additional Work
Requests made after proposal approval may affect cost and schedule. Unexpected site conditions, such as buried debris or unsuitable soil, may also require changes to the scope of work.
Design Recommendations
Plant selections are based on professional judgment considering mature size and climate suitability. As living systems, we cannot guarantee specific growth rates or harvest quantities.
Plant Sourcing, Installation & Scheduling
Plant Availability
Specific species, cultivars, rootstocks, sizes, and quantities are subject to nursery availability.
Some orchard varieties and specialty plants have limited or seasonal availability. If a specified plant becomes unavailable, we may recommend an appropriate alternative. Significant substitutions will be discussed with the client before installation whenever reasonably possible.
Natural variation in size, branching, shape, and appearance should be expected in living plant material.
Plant Quality
We make effort effort to source healthy, high-quality plants appropriate for the project. Plants are inspected during sourcing and installation, and we may reject material that does not meet our standards.
Nursery stock is nevertheless a living product. Conditions that are not externally visible at the time of purchase or installation can occasionally become apparent later.
Scheduling
Installation dates are estimates unless specifically agreed otherwise. Landscaping and orchard work can be affected by weather, soil conditions, plant availability, nursery delivery schedules, site readiness, equipment availability, and other circumstances outside our control.
Certain plants may also be intentionally installed during a particular season when doing so provides a better establishment opportunity.
We will make reasonable efforts to communicate significant scheduling changes.
Site Access & Preparation
Clients are responsible for providing reasonable access to the work area and informing us of known conditions that could affect installation.
Unless specifically included in the project scope, the property owner is responsible for identifying private underground utilities, irrigation components, septic systems, drainage infrastructure, electrical lines, and other improvements that may not be identified through normal utility-location services.
Permits, HOA approvals, easements, and other property-specific requirements are the responsibility of the property owner unless the proposal specifically states otherwise.
Plant Establishment, Irrigation & Warranty
Living Plant Material
Trees and other plants require ongoing care after installation. Successful establishment depends heavily on irrigation, weather, soil conditions, drainage, pests, wildlife, maintenance, and other environmental factors.
We take care to install plants according to appropriate horticultural practices, but installation cannot eliminate the risks inherent in working with living material.
Irrigation
Newly installed trees and landscapes require careful irrigation during establishment. Even when an automatic irrigation system is present, clients should periodically inspect plants and soil moisture rather than assuming the irrigation system is providing the correct amount of water.
The property owner is responsible for ongoing watering and irrigation monitoring after installation unless continuing maintenance has been specifically contracted.
Damage caused by insufficient watering, excessive watering, irrigation failure, clogged emitters, broken lines, changes to irrigation programming, or other irrigation problems after installation is generally outside our responsibility.
Plant Guarantees
Any plant warranty or establishment guarantee will be stated in the individual proposal or service agreement.
Unless specifically covered by such a guarantee, we cannot guarantee the survival or future performance of living plant material after installation.
Plant warranties generally do not cover losses resulting from circumstances outside our control, including:

improper or insufficient watering;

overwatering or poor drainage;
-
extreme heat, freezes, storms, fire, flooding, or other severe weather;
-
deer, rodents, gophers, livestock, pets, or other animal damage;
-
pests or diseases arising after installation;
-
herbicide, pesticide, fertilizer, or chemical damage;
-
vandalism, construction activity, or mechanical damage;
-
neglect or improper pruning;
-
irrigation system failure; or
-
changes made to the site or plant after installation.
If a plant appears to be declining, we encourage clients to contact us promptly. Many establishment problems are easier to correct when identified early.
Orchard Performance
Fruit production varies naturally from year to year and depends on factors including tree maturity, weather, chill accumulation, pollination, pruning, irrigation, soil fertility, pests, diseases, and ongoing maintenance.
For this reason, estimated harvest periods, mature sizes, production levels, and similar information should be understood as horticultural guidance rather than guaranteed outcomes.
Payments, Cancellations & General Terms
Deposits & Payment
Payment schedules will be provided with each proposal. A deposit may be required before design work begins, plants or materials are ordered, or an installation date is reserved.
Special-order plants and materials may require payment before ordering and may become non-refundable once purchased from a supplier.
Remaining balances are due according to the payment schedule stated in the proposal or service agreement.
Cancellations & Rescheduling
We understand that plans sometimes change. Clients should contact us as early as possible if a project needs to be postponed or canceled.
Design work already completed, labor already performed, and plants or materials already ordered may remain billable. Special-order or non-returnable materials may not be refundable.
Repeated or last-minute rescheduling may require a new installation date based on our current availability.
Ownership of Designs
Unless otherwise agreed in writing, drawings, planting plans, orchard layouts, concepts, specifications, graphics, and other original design materials remain the intellectual property of the company.
Clients may use completed plans for the property and project for which they were commissioned. Reproduction, resale, publication, or use of the design for another property or commercial purpose requires permission.
Photography
We may photograph our work for documentation, our portfolio, website, or promotional materials. We respect client privacy and will not intentionally publish identifying personal information or private details about a property without permission.
Clients who prefer that their property not be photographed or published are welcome to let us know.
